Carl Quintanilla: Families torn apart by immigration

No matter what your views are regarding immigration laws in this country, it's tough to watch the story we have for you.

It's about what they call "mixed-status families" -- families made up of both legal and illegal residents who are trying to stay together despite being separated by immigration laws that they have violated.

Take Jose Zaragoza, a legal resident since 1987. He met Ana, the woman he wanted to marry, while visiting Mexico. They married, then waited and waited to get legal papers to bring her into the country. When their patience ran out, Ana came into the U.S. illegally to join her husband, and they had two children, Daniel and Steven.

But Ana eventually paid the price for sneaking into the country. She was deported and now lives in Mexico, away from her kids, who -- because they were born in the U.S. -- are automatically American citizens. They see each other maybe every six months. They must choose between staying in the U.S., where they can build on what their father has done for the past 30 years, without their mother, or they can move to Mexico to live as a family, forfeiting the life in America they legally deserve.

This struggle to maintain family unity is the struggle of a whole generation of Latino Americans. The numbers are staggering. More than 3.1 million American children have at least one illegal immigrant parent, according to the Pew Hispanic Center. And two out of three children with an undocumented parent are citizens living in mixed-status families.

How do they manage to see or visit their deported mother or father? Sometimes by driving across the border on weekends. If they live far from the U.S.-Mexico border, it's obviously much tougher to see parents on a regular basis. The Zaragozas have been married for 16 years, but they've only lived together for six years.

None of this changes the fact that these families, in most cases, broke the law. And anti-immigration advocates argue the U.S. isn't tearing families apart. The law is the law, they say, and mixed-status families are always welcome to reunite in their country of origin.

But what about the children who are born here, through no choice of their own? Although they're natural-born citizens, they're born into a life of family turmoil -- unaware of the ways in which the debate over immigration in this country is altering their daily lives.
 
We think the story of these families offers a chance to look at how complex the immigration debate is in the U.S. None of the proposed solutions offers easy answers. Even maintaining the status quo creates real hardship for some families.

It's part of the experience of Latinos in America. And, for better or worse, it will shape the way Latinos view this country, as they become a more formidable force in American culture, politics and policy.

This issue is very personal to me. I am a US citizen who found love with an illegal immigrant 5 years ago. He was recently caught by immigration, which is the day I have always dreaded, and will be voluntarily leaving the country shortly. We still plan on marrying this year and having a family. It is a horrible situation and I feel helpless that my legal status cannot help the person I want to share my life with. I will not let the flawed immigration laws of this country prevent me from having the family life that I have always dreamed of.
I'm a tad confused... our 14th amendment DOES NOT (subject to the jurisdiction thereof) give a child birthright citizenship. Ademas... la toda de familia is ILLEGAL. And of course should be processed and immediately DEPORTED. If there is any "turmoil" in the equation, besides America's deteriorating liberty, it is the state of Latin America. But that is for the returning families to remedy. Buena suerte.  
My sympathy to these children but as the article states the law is the law.  We have many mothers in jail for breaking the law and they do not get pardons just because they have children living without their mother.  I also watch our senior citizens struggle financially because they worked hard all their lives and social security doesn't have the money to allow them to live above poverty.  Go without meds and food. And to let illegal people pardons because they broke the law and have children while depriving our elderly is unbelievable!!!  In all these years why has this family not made less than perfect choices to be togeather?  I know several families that have had to move and make less money/not live exactly where they want to be with their families.  It is all about choices!!  What is the most important issue with them?
The answer is compassion. The removal of illusory borders, guarding territories and minds, allowing the unity of all sentient beings...the purpose of life.
Why is this America's fault?  They made the choice to break the law.  Hispanics aren't the only ones waiting to immigrate, but they seem to think they shouldn't have to. Just break the law then demand it be changed....right?  

If I rob a bank and I go to jail, I am separated from my family and they cannot come and live with me.
Illegals come diseased, commit crimes demand social services they do not pay for, crowd the schools and live as third world. They make little effort to assimilate or learn the language. They are lawbreakers!

I do not want to buy a home built by illegals who cannot read a ruler.  Send them all home with their children and problem is solved.
They should have thought about that before having children.  The fact remains that she was here illegally and could be deported.
It is unfortunate that Jose and Ana premeditatedly broke the law.  As responsible people, they must accept the consequences of their decision.  The American people have not one iota of blame and have no responsibility or obligation to fix the problem Jose and Ana created.  Fortunately, there are no impediments for the family to remain together in Ana's home country.  As a responsible parent, Ana should immerse  her children into the culture of her native country.  When the children are old enough, they can decide where they would prefer to live.  
I don't think the children should be automatic citizens because they are born here. I remember cases of women making it across the border to deliver their babies on the U.S. side. The current law is the law and even you're here 50 years, if its illegal, you should go back to your country
Thank you Carl For bringing this important issue up... many families are suffering in private over this exact issue, and are scared to be torn apart. I hope a solution can come quickly.......... through our elected President and elected Officials. I applaud the Today Show for informing more viewers of this important topic, Families should not be torn apart, the laws need to change to accomdate families in these situations.
It is hard for me to feel sorry for illegal immigrants. They know they are breaking the law and no matter how flawed it is, it is still the law. Also if two illegal immigrants have children in the United States that child should not automatically be given US Citizenship! Illegal immigration is crippling this country both physically and finacially!!!!
Miss Munoz maintains that her parents are NOT crimmals.  Fact: they BROKE the law.  FACT:  that makes the parents crimmal.  They gambled and lost.  They should try to make a home for their family in Mexico instead of the constant back and forth.
Yes, the immigration debate is complex, but, the botton line is, they broke the laws coming into this country.  They need to accept that fact.  That is what the Hispanic/Latino nation seem to overlook.  They think we, Americans, should overlook that issue.  

If they want to be a family again, they can.  The solution is move back home with your parents to their home country, wait your turn, and reenter the correct way.  LEGALLY!!
If these people want to be with their families let them move to Mexico. I find it hard to believe any put a gun to their heads and forced the parents to come to this country...nor did anyone force them to have children to get our benifits....If the kids miss their patehts go back to Mexico...now,
What about the victoms on the oppisite end, like myself who is an american citizen, married a Jamaican, pettitioned for his 7yr old daughter, then after she arrives in the US he takes off with her. What about my rights, how can the violaters have more rights than the victoms? What ever gets done about this type of situation? As I keep finding out there is next to nothing that can be done.
I agree with what the judge decided in this case, if you do not follow the laws we have in place to come here, you should not be allowed to stay. As a citizen of the USA I have to follow allthe laws. We all have to. This family is not together because some of them disrespected our laws. If they really wanted to be together, those children would choose to go live with their parents in mexico. I would not choose a home or town over the love and Time with my mom. It sounds like they want what they want, not that they want to be together.
Why did no one ask why the children or families not choose going together to Mexico?
I understand that the children are suffering, but the parents broke the law.  I am a mother, but A law is a law is a law-if I choose to break the law to better my child's life would I be excused from my crime because it benefits my children?    
Immigration laws are there to protect us.  We can't start making exceptions because the parents wanted a "better life".  There are parents who still from stores to feed their children, but that doesn't make it right either.  Laws are meant to protect the citizens of the United States.  We cannot bend the rules to assist those who choose to willfully break the laws. The parents in the story couldn't even speak English and admitted they grew impatient waiting. I hope our government continues to inforce these immigration laws!!!
Tough situation. Ultimately these people broke the law and knew the ramifications so the tears have little effect on me anyway. I have plenty of friends who came here legally. To be fair, I wonder how many real hard-core criminals would slip into this country if the laws were changed.
All laws considered (as it doesn't seem that US citizenship can be gained any time fast after breaking the law), I can't see why they don't take the wealth they built and try to get citizenship in Mexico (or elsewhere) and keep their family together.  
The family of five whose parents were deported was a very heart wrenching story....or was it?  The only thing keeping this family apart is their own personal choice.  There is absolutely nothing stopping these kids from being with their parents in Mexico.
I'm sorry for the children. Why don't the parents do the right thing and become American citizens? I would think that would be the right and proper thing to do.
I don't think this story is complicated at all.  Children born to illegals in this country should also be illegal and deported.
They broke the law, they are criminals.
Some arrangements need to be made for hard working people, only guilty of seeking a better life.
Thank God I was born here.

I do feel sorry for these children, whose parents chose to break the law to come to America & then chose to leave them behind when they were deported. What kind of parents are these? If you wish to make a better future for your family, do it legally and you will not have to make these difficult choices down the road.
It's sad that these children have been put into this situation by their parents.
If Mexico isn't fit to live in then the citizens there should fight for changes in their corrupt government, NOT take advantage of another counry and it's citizens.

Illegals are the main reason CA is broke and getting more broke daily.

They ARE criminals because they are here illegally. They broke the law and there are consequences for that. If not, then empty the jails and prisons of Americans and let them have a free pass also.
I am all for playing by the rules but you cannot deport BOTH PARENTS and leave the children here!? What kind of country do we live in...UNLESS YOU ARE AN AMERICAN INDIAN WE ARE ALL DECENDEDS OF IMMIGRANTS! What about what it states on the statue of libery: Give us your poor, your tired, your huddles masses longing to be free?
To get a visa in Mexico to come here you have to go and pay $131 (which is a lot to many mexicans) then you pay it and can easily be denied...only to have to repeat the process again another day which can again be denied after you pay the $ again...
I just think it's wrong!
We have laws in this country. If illegal immigrants break the law, they should be deported, no matter if they have kids in this country. What message are they sending their kids if they break the law and just hope that they don't get caught? When my great-grandfather immigrated to this country, he did it legally. He was expected to follow the law, why should it be different for anyone else? It shouldn't. As a parent I teach my children right from wrong. Breaking the law has consequences!
While it is heartbreaking to see families torn apart, it was their choice, to make the decesions they made to put "their family" in jeopardy, not ours.  If the issue is the law, then breaking the law does not warrant special attention.  Changing the law should!
Watching this story this AM regarding this family is unfortunate, however, the parents are the ones who created the problem in the first place.   They came to the US illegal and now are paying the price.   I'm glad our laws are being enforced.    Please place the responsiblity for this where it belongs not on the US
Thank you for addressing this issue. It is time to keep families together. I simply cannot understand how "Christian" conservative "family values" driven people can support any policy that rips children away from their mother or father, when all that parent has done is make a decision to help their child have a better chance in life, and afford them with better opportunities. Since when did amnesty and forgiveness become bad words in this "Christian"country? I am a Christian, but I do not want to be associated with people who claim that title in an attempt to deny other people God-given rights.
While I totally feel for the families spotlighted in this piece, I also feel for other families where one member broke the law....and all paid the price.  Other than the one opposing view which was only on camera a few seconds, this interview was clearly designed to convince us that our laws should be changed. After all, people are hurting.  Yes, people are hurting.  Yes, the story was sad...but it insulted my intelligence.  If we grant amnesty to illegals, we indeed say to all those who are waiting to LEGALLY immigrate to this country, "don't bother".  I feel sad for the children interviewed by Ann, but not because America did them wrong....but because their parents broke the law.  If we start saying people can break the law in order to "better" their family....slippery slope, to say the least.  Total chaos at best.
It is pitiful,these children have been put in this position. But the parents did this to them. They are illeagle,this is apart of what is breaking down the USA.We cannot keep all of them up.Most are on some type of state funding,mainly because of the children. Maybe they need to go back to Mexico,& come visit USA. Yes I am the mother of two sons,but I would have never done anything to risk being taken from my kids. Why dosen't their dad get leagle in the USA? Or is he banned also? I wish this was aired in the evening, when most are home from work & school. Also this is one main show that needs to be in Spanish. Get leagle or go back to Mexico,is my theory........
I've just watched this and though my heart aches for the kids, I find it hard to be sympathetic for the parents who started their familes knowing that they shouldn't even be here.. We are 8/9/10 years (it's been so long I forget) into our green card application and $21,000.00 later, we appear to be no nearer to getting one.  We are having to re-do (and of course, pay again) certain things like finger-printing, medicals etc because they are out of date.. how crazy is that!!  It's not fair when we have played by the rules AND spent big bucks.. so do I think there should be an amnesty for these families NO I DO NOT.. GET IN LINE!!!!
I am sorry that these families are broken up, but, they knew the risks when they broke the law.  We have families that are broken because someone is in jail.  Do we let them out so that they can be a family again?  Also, are they paying taxes like the middle class American has to do?  Where does it end?
This should be against the law!!!!  These parents should NOT be taken from their kids. Kids shouldn't be raising kids! Family hardship should be legit reason for allowing these people to stay in this country. Each case should be looked at individually and judged on its own merits.
I wish there was a way I could help those children, if I didn't live in Florida I would take them and have them live with me.  Where is Catholic Charities in this case, I'm so sad for them.  I hope the Today Show continues to take interest in this story and follows up with these children.
families should not be kept apart, yet when legal families do things that are illegal they are seperated from their families. the main point is the breaking of the law. we are the only country that gives naturalization or citizenship to illegals born within our borders, and probably the only country that rewards those who break the law. there is no patriotism, accountability, or good sense in this. pride in our country as well as paying of taxes, social security and other benefits as others do and not just enjoyment of the "american dream". no one born in this country or in any country should be a legal citizen of that country unless 1 or both of their parents are legal citizens of the country in question, and i dont believe in the grandfather clause in this regard either.      
This story really touched my heart because currently my sister has been in mexico since may 07 with her stepson who turned a year old this last may. They have been trying to do everything the legal way. My brother- inlaw has seen his baby maybe 8 wks in the last year. He is up here working while my sister who is an American is in mexico caring for her step-son.Immigration told her to go home and leave a baby.
Enough is enough about this issue! Yes, maybe Mr Zaragoza's wife was feed up, but when you break the law you pay the price.  My husband came from Czech Republic and DID everything correct and is a legal resident, so why should I feel sorry for someone else.  First, we are making folks become US citizens we just ask that you get work authorization papers which can be renewed each year, then it's up to you to make the choice to go to the next level.  It makes me upset that you have children here and then DO NOT take the correct steps to become LEGAL all you want is for folks to feel sorry for you.  I've heard alot of folks who have children that are US citizens and they are not, they say if I do the correct thing by beging a legal resident here I'll lose benefits I'm getting now!!  
One of the girls said her parents aren't criminals, but they actually are. They broke the law by being here illegally.
There's so many illegals here now that they believe they can bully and threaten Americans in order to get what they want.
They have no right to gather and protest, they have no right to threaten and bully American ciizens.

As a person who lost her job 6 weeks ago to 2 young ladies (who spoke very little english) but I trained to be my back ups( that's what my boss told me) I feel there is another side to this story that needs to be explored. Illegal aliens mean persons in the country without permission.  Yes! there parents came here legally but, they bought a house instead of paying for the needed immigration procedures to be taken. Cheap labor forces are helping create this economic problems a lot of us are facing.
Hi, Carl. I watched your segment about Jose Zaragosa and family on this morning's Today Show. I am a descendant of anglo-saxons who came here in the 1600's. I am a blue collar guy in his 60's who lives in rural, conservative, mountainous, western Virgina. The very existance in this country of MS-13 makes my stomach churn and my blood boil. Something else makes my blood boil much harder, much hotter, and much faster. Mr Zaragosa is a apparently a legitimate, hard working, honest, tax paying, loyal resident of the awesome U.S.of A. This country has relied upon immigration since it's creation for it's very existance. We'd be saluting Tojo and Hitler. and all eating out of trash dumps if it were not for immigrants. Mr Zaragosa's son is an Americam kid, of Mexican descent. He has every chance and every right
to become the Chief Justice of the Supreme Court, or  the Postmaster general of the U.S. No beaurocratic agency is flawless, no laws pertaining to things like immigration are without problems. The arrest and deportation of Mrs Zaragosa is a travesty of justice. Whether those who implement and enforce the statutes realize it or not, we NEED her in this country. Who do they think built this country? Who do they think protects this country in times of war? Who do they think raises the next generation of productive citizens. If they bother to read history, they'll soon realize that not every worthwhile citizen who

My grandparents had to come to this country legally, learn the language, get all the proper documents, spend countless hours becoming an american citizen  - so too should all immigrants.  Americans are losing their jobs, are in extreme financial strife, are losing their medical benefits, facing eviction because they can't pay their rent so how is it fair that we are losing our jobs to illegal workers.  shame on the contractors that hire them and shame on the gov't for not realizing that illegal immigration is a growing problem in our country.  while I feel sorry for the family on tv ... americans need to protect their livelihood too!
One of the things that makes this unique in our history is the close proximity of the "old country" in relation the new.

In the past, immigrants, whether legal or illegal, made the decision to cut their ties to the past and throw in their lot with their new country.  They did this, leaving behind family, language, and culture, knowing that, in all likelihood, they would never return to the land of their roots.

Today, not just with Mexico, which is virtually right next door, but with any number of other countries, the world has gotten smaller - there's less perceived need to leave the old behind in favor of the new.

Whether that is a good thing is highly arguable.

I worry about the "tossed salad" or mosaic model versus the traditional melting pot; particularly in its response to stress.

Drop a stone into an iron kettle filled with soup.  It may generate a splash, but when the ripples subside, it's still soup.  Drop the stone onto a mosaic, and it shatters.

The potential fracture points in a collection of Balkanized subgroups unwilling to assimilate into the larger culture does not strengthen us as a society
This is somrthing i ahve given thought to before, in my opinion I will have to say sorry. But if they came here without prior planning and  doing what our country asks for, how can you expect for us to change for you? It's like you're coming into my house and demanding I change my rules. This is something the children have to suffer because of the parents.
This family was not torn apart by immigration as the headline states; they were torn apart by the unlawful actions of the parents who decided to try to circumvent the legal process for becoming a citizen of the United States. The quickest way to resolve this issue is to stop allowing our 14th Amendment to be used as a loophole to allow people who do not have legal authority to live and work in our country to claim citizenship for their offspring.
They should not have broken the law.  If it were reversed and an american citizen went to another country and married someone.  We would be sent home or jailed!
I found this phrase telling:  "...for better or worse, it will shape the way Latinos view this country, as they become a more formidable force..."  It implies that illegals eventually will become legal and hate the gringos, the laws and what they stand for.  If so, why would they want to come here?  It's absurd.
Those people who offer disdain for borders, for entry laws; How many immigrants shall we admit? Should we just do away with citizenship laws? Fine, then YOU accommodate them with your money. There must be limits and laws. We need an amendment to prevent "grappling-hook" babies by illegal entrants into this country. Our resources are finite.
